Entity: Crowdstake AI, Inc. ("Crowdstake," "we," "our," or "us")

1. Overview

Crowdstake provides an AI-powered platform that allows creators ("Creators," "you") to design, host, and manage pre-launch landing pages for their projects. These pages enable the collection of waitlists, interest signals, and paid reservations through a Stripe-powered widget ("Crowdstake Widget").

By using Crowdstake, you agree to these Terms of Service ("Terms") and to our Privacy Policy. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 18 years old to use the Platform. By registering, you represent that all information you provide is truthful and accurate and that you have the authority to bind any organization you represent.

3. Crowdstake's Role

Crowdstake provides the tools and infrastructure for creators to collect paid reservations from their audiences.

Crowdstake is not a payment processor, merchant of record, or financial intermediary.

Payments are processed through Stripe Connect, and creators are required to establish a Connected Account to receive funds.

Crowdstake never stores full credit card details or direct payment data.

4. Creator Responsibilities

Creators are solely responsible for:

Managing their projects and ensuring all representations (pricing, delivery, timelines, etc.) are accurate.

Complying with all applicable laws and regulations regarding consumer rights, refunds, and taxes.

Handling all refund requests or payment disputes with their end users directly.

Crowdstake does not handle refunds and is not financially responsible for disputes between creators and their end users.

5. End-User Transactions

When an end user ("Supporter") makes a paid reservation through a Creator's page, that transaction occurs between the Creator and the Supporter.

Crowdstake merely provides the technical interface and does not guarantee fulfillment of reservations or delivery of any goods, services, or projects.

6. AI-Generated Content

Crowdstake's platform may use AI models to generate text, layouts, or suggestions based on the data you provide.

You retain ownership of your original content.

Crowdstake retains a limited license to process, host, and use your content to provide and improve the service.

AI outputs are provided "as-is" without warranty of accuracy, originality, or fitness for purpose.

7. Data Collection and Privacy

By using the Platform, you grant Crowdstake AI, Inc. the right to collect, process, and store data related to your project, content, and audience interactions.

Data handling practices are described in detail in our Privacy Policy.

8. Fees and Payments

Crowdstake may charge service fees for use of certain features. Any applicable fees will be disclosed prior to your use of a paid feature. Crowdstake reserves the right to modify its pricing or fee structure with reasonable notice.

9. Prohibited Uses

You agree not to:

Use the Platform for illegal, harmful, or fraudulent activities

Collect or distribute personal data without consent

Interfere with system security, reverse engineer, or scrape our platform

Use Crowdstake to fundraise for prohibited products, services, or causes

Violation may result in account suspension or termination.

10. Intellectual Property

All software, branding, and design elements of Crowdstake remain the exclusive property of Crowdstake AI, Inc. You may not use our trademarks or copy platform elements without written permission.

11. Disclaimers and Limitation of Liability

The Platform is provided "AS IS."

Crowdstake disclaims all warranties, express or implied, including merchantability or fitness for a particular purpose.

To the fullest extent permitted by law, Crowdstake's liability shall not exceed the amount you paid (if any) for platform access in the 12 months prior to the claim.

12. Indemnification

You agree to indemnify and hold harmless Crowdstake AI, Inc. from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your content, or your violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles.

Disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association.

EU or UK users may alternatively seek resolution in their local jurisdiction under applicable consumer protection laws.

14. Modifications

We may modify these Terms at any time. Updates take effect when posted on our website. Continued use of the Platform constitutes acceptance of the revised Terms.
